Due to the reform incorporated by Law 21,435, of 2022, to the Water Code and the mandate provided by the transitory norms of the aforementioned Law, with respect to public institutions, it is necessary to review how to implement the powers of the Authority that are have incorporated or strengthened, as well as to verify if they are sufficient or if it is necessary to think about a new structure, for example through a National Water Agency or an Undersecretary of Water Resources, which assumes competences in terms of plans and programs, leaving the technical to the General Directorate of Water.
With regard to Water User Organizations, the figure of the Strategic Water Resources Plans in Basins and the forthcoming incorporation of pilot projects of basin councils in each of the country’s regions, pose the challenge of making compatible and articulating the role of said user organizations and integrated watershed management. Additionally, future challenges are considered, on the one hand, to modernize the process of constitution of user organizations – with special focus on groundwater communities – improving the times committed in said processes; and, on the other, devising the mechanisms that allow the proper integration of groundwater into the management that is currently carried out on surface water.
